Settle in the UK

in various immigration categories

You must usually have lived and worked in the UK for 5 years. If you have a tier 1 visa, it can be 2 or 3 years. If you have an Innovator or Global Talent visa, it can be 3 years.
You may also need to meet the salary or financial requirements - this depends on your visa.
Sub Cat – ILR on family life – 5 years route
You may be able to apply for indefinite leave to remain if you have a family member settled in the UK - either as a British citizen or a person with indefinite leave to remain.

Your current visa must be based on your relationship with your partner. You must be either:
  1. A husband, wife or civil partner
  2. In a relationship that’s like a marriage or civil partnership

You must also:

  1. Have lived together since you last renewed your visa
  2. Intend to continue your relationship after you apply

Time you’ve spent in the UK

  1. You must have been living in the UK on your family visa as a partner for at least:
  2. 5 continuous years if you’re on the 5 year route
  3. 10 continuous years if you’re on the 10 year route
  4. 2 continuous years if you’re on the 2 year route

If you’re on the 10 year route, you can include time you’ve spent on both the 5 year route and the 10 year route to count towards your continuous residence.

Knowledge of language and life in the UK

If you’re 18 to 64 you’ll need to:

  1. Book and pass the Life in the UK Test
  2. Meet the English language requirements by having a recognised English qualification with at least level B1 in speaking and listening or a degree taught or researched in English

Requirement:

You’ll be told which documents you need to provide when you apply. You’ll need to:

  1. Give proof of your income and where you live
  2. Prove you’ve lived in the UK with your partner since you got your last visa
  3. Prove that your relationship with your partner is genuine
  4. Prove you meet the English language requirements and have passed the Life in the UK Test

You may be able to apply for indefinite leave to remain if both:

1. you’re a dependant on your partner’s work visa

2. your partner settled in the UK using their work visa

If your partner settled in another way, for example because they had been in the UK for 10 years (‘long residence’) you cannot apply to settle as a dependant on their work visa.
Your eligibility depends on the visa your partner had, your relationship with your partner, how long you’ve been in the UK and whether you meet the financial requirements.

You may be eligible for indefinite leave to remain if you have a family visa as a parent.
Your child must be living in the UK and either:

1. Be settled in the UK - either as a British citizen or a person with indefinite leave to remain

2. Have got permission to stay after living in the UK continuously for 7 years

You may be able to apply for indefinite leave to remain as a child.
You may be eligible if both:

1. You have a family visa as a child - there’s a different way to apply if you’re a dependant on your parent’s work visa

2. Your parent is a British citizen or settled in the UK
You may also be able to apply if you either:

3. Are under 18 and were born in the UK before your parent settled here - you can have any immigration status, including if you never had a visa

4. Have ever been a dependant on a relative’s visa - they must have had refugee status or humanitarian protection before settling in the UK

You must be able to prove all of the following:

1. You’ve had permission to be in the UK as your parent or relative’s dependant
2. You are or will be living with your parent, parents or relative
3. You’ll be supported and accommodated adequately without using public funds
4. You’re not married, in a civil partnership or living an independent life
